MPF e TCU defendem regulamentação dos planos coletivos
O Grupo de Trabalho Planos de Saúde do Ministério Público Federal se reuniu, na semana passada, com representantes do Tribunal de Contas da União (TCU) para tratar sobre planos coletivos de saúde. Os dois órgãos planejam atuação conjunta para garantir a regulamentação do serviço nessa modalidade.
O plano coletivo, que pode ser feito por empresas para os funcionários ou por grupos formados em sindicatos ou associações, tem regras menos rígidas que os individuais. A legislação não regulamenta os direitos e deveres das operadoras e consumidores dos planos coletivos, como taxa de reajuste, por exemplo.
Apesar de a Agência Nacional de Saúde Suplementar (ANS) argumentar que não pode fiscalizar o serviço porque a lei trata apenas dos planos individuais, o GT entende que não há impedimentos legais para que a agência regule também os coletivos.
Segundo o Ministério Público, não existe transparência na forma de reajuste anual dos planos coletivos. Com isso, as operadoras têm preferido tal modalidade aos planos individuais. Já o TCU apontou falta de aplicação e recolhimento de multas por parte da agência reguladora. (PrevTotal)
